Code of Criminal Procedure, 1973–Sec. 125–Scope–Inability to maintain herself is the pre-condition for grant of maintenance to the wife–She should aver and prove this fact–Additionally she should prove that the husband has sufficient means to maintain her and has neglected to do so.
