Code of Civil Procedure, 1908–Order 7, Rule 11–Hindu Marriage Act, 1955–Secs. 2(2)–View of Court below that there is no provision in Order 7, Rule 11 for rejection of plaint based on jurisdiction–Plaint can be rejected if it is barred under any law–If the applicability of provisions of Sec. 2(2) is upheld, the same would necessarily result in the proceedings barred by law–Impugned order set aside and matter remanded back for deciding the application afresh.
