Rajasthan Panchayati Raj Act, 1994–Sec. 97–Rajasthan Panchayati Raj Rules, 1996–Rules 167 & 142–Cancellation of pattas on the ground that the procedure provided in Rule 142 had not been followed and certain reservations were allegedly not provided–Justification–Petitioners participated in an open, transparent and statutory auction conducted by the Gram Panchayat and emerged as successful bidders after depositing the requisite amount–Gram Panchayat undertook all statutory and procedural formalities–No allegation of fraud mis-representation or sale below prevailing DLC rates–The auction proceeding were not only compliant with statutory mandates but also generated substantial revenue for Gram Panchayat–Any procedural irregularity, if at all, are minor, attributable solely to administrative lapses and capable rectification without prejudicing the rights of bona fide purchasers–Statutory remedies provided under Rule 166 and Sec. 97-A were by-passed–Impugned order is manifestly illegal, arbitrary, and devoid of jurisdiction–Set aside.
