Specific Relief Act, 1963–Sec. 12–Code of Civil Procedure, 1908–Order 7, Rule 11–Limitation Act, 1963–Art. 54–Rejection of suit by the Revisional Court on the ground of limitation–Objection of limitation may be permitted to be raised by the defendants in the written statement and on raising such objection, the Trial Court may take into the same in the context of legal position and the evidence so brought on the record–Matter cannot be adjudicated on the application under Order 7, Rule 11, as done by the High Court–Impugned order set aside and suit restored.
