Code of Criminal Procedure, 1973–Sec. 438–Penal Code, 1860–Sec. 302–Dismissal of anticipatory bail application–FIR was lodged by the brother of deceased after 29 years from the date of incident and after a period of nine years from the decision by this Court–Appellant has retired in the year 2018 from the post of Director General of Police–Initially, FIR was lodged for the offences u/s. 364, 201, 344, 330, 219 & 120-B wherein he got the anticipatory bail–Offence u/s. 302 was subsequently added on the basis of statements of approver–Held, the appellant has made out a case for granting the anticipatory bail.
