Penal Code, 1860–Secs. 376, 494, 495 & 420–Charge framed for the offence–Justifica-tion–Petitioner came in contract with the prosecutrix at her workplace and developed the physical relations with her on false assurance of marriage–Prosecutrix was a grown-up woman and she had sufficient intelligence to understand the significance and moral quality of an act she was consenting so–She must have known the consequences of the act, particularly when she was conscious of the fact that their marriage may or may not take place–Matter deserves to be remanded back to pass a fresh order on the charge u/s. 376.
