Justification–Land was belonging to the member of S.T.–He failed to redeem the mortgage with bank and bank sold to it in auction proceedings to Respondent No. 2 who was not the member of SC/ST–Contravention of provisions of Sec. 42(b)–Further, this is not a case governed by the Sec. 14(1) of Rajasthan Agriculture Credit Operation (Removal of Difficulties) Act, 1974, because the land was not acquired by the bank despite of non-purchase of same in public auction–Held, B.O.R. ought to be allowed the reference.
