Penal Code, 1860–Secs. 376(A), 376(3), 302 & 201–Protection of Children from Sexual Offences Act, 2012–Sec. 5(J)(iv)/6–Conviction–Circumstantial evidence–Recovery of adhar card of accused from the place of incident–Recovery of blood-stained pant and shirt on which the mixed DNA profile was obtained–His DNA profile was found matched with the DNA profile obtained from soil recovered from the crime scene, vaginal swab of deceased and underwear of deceased–Signs of sexual assault were found in the postmortem report of deceased–Accused failed to establish his defence in the statements u/s. 313–Held, trial Court did not commit any illegality in convicting the accused.
