Code of Criminal Procedure, 1973–Secs. 154 & 157–PW 4 stated that the first informant was not present at the place of incident, and he was not seen till evening when the police left after conducting investigation whereas according to Investigation Officer, he arrived there with the Police–Investigation conducted in the present case is not fair and unprejudiced–Faults in site plan–FIR was not sent to Magistrate on same day–Strong possibility that the FIR is a post investigation document.
