Code of Criminal Procedure, 1973–Sec. 161–A mason and a labourer were working at the place of incident–Their statements were not recorded before the Trial Court, despite the fact that their statements u/s. 161 were recorded–This fact puts the serious dent on the reliability of case of prosecution.
