Code of Criminal Procedure, 1973–Sec. 439–Penal Code, 1860–Secs. 302 & 34–Bail was granted to accused I by this Court by treating her case as if there was no evidence of last seen against her with the deceased whereas she was very much last seen in the company of the deceased along with other three accused-persons–Statements u/s. 164 of the witnesses of last seen enclosed with the charge sheet annexed with the bail application were not supplied to the Public Prosecutor–She concealed and suppressed the material facts and approached before this Court without clean hands–She has attempted to pollute the stream of justice–Order of granting the bail deserves to be recalled.
