Penal Code, 1860–Secs. 302, 304B & 201 [Corresponding Secs. 103, 80 & 238 of BNS, 2023 ]–Acquittal from the offence–As per Ex. P.2, death of the deceased occurred due to heart failure in the early morning–Prosecution did not examine two witnesses N & M inspite of the application moved by the defence for their examination–Latter on, defence examined the witness M and he stated that the father of deceased was informed through the telegram–On the basis of evidence produced by the prosecution, no case for any harassment or demand of dowry to the deceased has been made out–Parents and other relatives did not reach to village on the day of cremation or after that–None of the ladies belonging to the parental village of the deceased raised any issue or informed to the police–Trial Court has dealt with the evidence at a length–Held, no case is made out for interference.
