Penal Code, 1860–Secs. 302/149 &100–Acquittal–Appreciation of–Complainant party was armed with the sharp edged weapons and lathis and it was responsible for the fight–It was stood convicted by the Trial Court–Every member of accused party was having the apprehension of death and grievous hurt–Case would fall in the ambit of Sec. 100–Case is of the year 1983 and leave to appeal was granted only against four persons–Out of them, two have expired–Declined to entertain the criminal appeal.
