Penal Code, 1860–Secs. 376, 342, 323 & 506–Acquittal–Appreciation of–Prosecutrix and her father stated the age to be 13 years, however, her mother stated that her marriage was solemnized before 20 years and prosecutrix was born just after two years of marriage–Prosecutrix herself stated that she was not forcibly taken away–Further, she was indulged in sexual intercourse with the accused prior to incident of rape–Case was registered when the accused did not pay the money before village panchayat–No cogent evidence in regard to rape–Held, acquittal was justified.
