Code of Criminal Procedure, 1973–Sec. 228–Prevention of Corruption Act, 1985–While discharging the accused , High Court went into the merits of the case and considered whether on the basis of material on record, the accused is likely to be convicted or not–High Court considered in details the transcript of the conversation between the complainant and accused–At this stage, it was not permissible at all–Defence on merits is not to be considered at this stage–Impugned order of High Court is unsustainable and deserves to be quashed and set aside.
