Penal Code, 1860–Sec. 302–Acquittal from the offence–Justification–Murder of wife–Except some minor contradictions, all three eye-witnesses clearly deposed that the accused respondent caused several injuries and the incident was seen by them–As per post-mortem report, injuries were caused by sharp edged weapon and injury nos. 2 & 6 were sufficient for causing death–Blood stained kassi was recovered from the house of accused and blood group of blood found on it was found matched with the blood present on the clothes last worn by the deceased–Except one prosecution witness, all other witnesses supported the recovery without any material contradiction–Trial Court omitted/misread the material evidence available on record–Accused-respondent is liable to be convicted.
