Penal Code, 1860–Secs. 302/34, 307/34, 324/34 & 323 [Corresponding Secs. 103/(3), 109/3(5), 118(1)/3(5) & 115(2) of BNS, 2023]–Acquittal from the offence–Appreciation of–Injured admitted that injury on his head was inflicted from the back side and after causing injury, he became unconscious–He also admitted that after that, he did not remember as to which accused hit whom and how many times–PW 7 also admitted that he heard that someone had been murdered–It is not established beyond the doubt that the deceased was murdered by the respondent-accused–Witnesses of recovery of the weapon also turned hostile–Held, acquittal was justified.
