Code of Criminal Procedure, 1973–Secs. 227 & 228–Framing of charge–Functions of Court at this stage–Court is supposed to consider broad probabilities of the case, total effect of the evidence & documents produced before it–Court has the power to sift and weigh the evidence up to the limited purpose for finding out whether or not a prima facie case against the accused is made out–The roving enquiry into the pros & cons of the case is not required–Court should go into the probative value of the material on record.
