Arbitration & Conciliation Act, 1996–Sec. 34–Appeal against arbitration award–Dismissed by the Commercial Court–Arbitrator awarded the amount for the excess lead as the sand was not available at the distance of two kilometers –However, there was a specific bar on payment of the extra amount for change of source/lead–It was beyond the scope of the arbitrator to go beyond the terms of the agreement–Amount of award on extra lead cannot be granted–However, the contractor was entitled for the claim of extra work done on the assurance given by the appellant–Objection to the claim of Rs. 14 lakhs on account of enhanced work cannot be sustained.
