Penal Code, 1860–Secs. 302, 120-B &34 [Corresponding Sec. 103, 61(2) & 3(5) of BNS 2023]–Acquittal from the offence–Case of circumstantial evidence–Case set up by the prosecution as regard to land dispute and motive was solely based upon the probabilities/doubts being expressed by the family members of the deceased–Information regarding the location of weapons was collected from the accused after six months–No justifiable explanation regarding such delay–No link between the recovery of weapons and offence–Accused persons themselves were having conflict interest against each other with regard to their desire/claim over the land–Held, acquittal was justified.
