Rajasthan Tenancy Act, 1955–Sec. 16–Allotment of land for cement plant–Subject land has been classified as the Johad and it does not fall in the catchment area–No natural source of water is existed on the land–Recommendation for change of class of land in the light of report of Tehsildar–Gram Panchayat also passed the resolution–Respondent-company also gave the undertaking that the environment of village will not be adversely impacted and the ecological balance shall be maintained–Decision rendered in the case of Abdul Rahman cannot be impediment for processing the application of the respondent-company for allocation of the subject land for setting up a cement plant–Held, judgment passed by the High Court deserves to be upheld.
