Code of Civil Procedure, 1908–Order 37–Suit for recovery of money–Dismissal of–Allegation of failure of the respondent-defendant to complete transportation work within the contractual period–Right to sue first accrued on 30.06.1983 and limitation prescribed is three years from the date when the goods ought to have been delivered–The suit ought to have been filed on or before 30.06.1986 and it was instituted on 19.01.1993 which was ex-facie barred by limitation–Plea of appellant that the period spent in the proceedings under the PDR Act should be excluded, has no merits because the PDR Act does not have effect of extending or suspending the limitation for a civil suit–Section 14 of Limitation Act applies only where a litigant has been prosecuting another civil proceedings before a Court or quashi-judicial forum which lacks jurisdiction–Furthermore, the plaint was not signed and verified by a duly authorised officer of the State–Trial Court rightly concluded that the plaintiff no. 2 was not competent to file the suit–No reason is found for interference.
