Arbitration & Conciliation Act, 1996–Sec. 34(3)–Limitation Act, 1963–Sec. 5–Proviso to Sec. 34(3) empowers the Court if it is satisfied that the applicant was prevented by sufficient cause from making the application within the prescribed period of three months to further extend the period and filing the application for setting aside the arbitral award by thirty days but not thereafter–Provisions of Sec. 5 of Limitation Act do not apply to the proceedings contained u/s. 34 of the Act–Award was passed on 29.07.2020 and application for setting aside the same was filed on 21.11.2020–Held, same could not have been entertained by taking the recourse of the provisions of Limitation Act and the application was rightly dismissed.
