Penal Code, 1860–Secs. 409, 420, 467, 468, 471 & 120-B–Prevention of Corruption Act, 1988–Sec. 13(1)(d) r/w. 13(2)–Discharge from offence–Appreciation –Allegations that the respondents accepted the tender of a firm which was not having the eligibility criteria–Two tenders were of similar rates and the work order was given after receiving directions from superiors–Respondent no. 1 jointed the post after the tenders had invited and remained on that post for only 47 days–Things ordered by respondent no. 2 were though beyond sanctioned quantity, however, completely used by department–No misuse or undue profit was earned by him–Respondent nos. 3 & 4 are simply store-keepers–Nothing to show that the material supplied was of lower quality–Held, the discharge was justified.
