Prevention of Corruption Act, 1988–Sec. 19–Code of Criminal Procedure, 1973–Sec. 197–Prosecution sanction against a retired public servant–Requirement of–Held, protection u/s. 197 is available to the concerned public servant even after retirement, however, if the offence is under the provisions of the Prevention of Corruption Act, prosecution sanction u/s. 19 will not be needed.
