Penal Code, 1860–Sec. 304-A–Applicability of Section–Held, following three conditions must exist for applying the Section-
(i) there must be the death of the person in question,
(ii) the accused must have caused such death, and
(iii) such act of the accused was rash or negligent and that did not amount to culpable homicide.
