Penal Code, 1860–Sec. 302–Punishment for the offence–Any punishment less than the imprisonment for life for the offence punishable u/s. 302 would be contrary to Sec. 302–High Court was not justified in reducing it up to the period of already undergone which is less than imprisonment for life.
