Code of Criminal Procedure, 1973–Sec. 482–FIR–Quashed by High Court on the ground of compromise–Justification–Respondent no. 2 filed the complaint on the basis of information received under the Right of Information Act–Allegations were with respect to withdrawal of salary for a certain period during which the respondent no. 1 was on foreign trip–After setting the criminal machinery into motion the complainant did not have any locus to compromise the matter with the accused when the FIR had been registered–High Court failed to consider the aspect of the matter–Further, the High Court did not consider the reply filed by the State in quashing the petition–The allegations against the accused are of defrauding the State and the matter cannot be settled on the basis of a compromise between to private individuals–Impugned order passed by the High Court is liable to be set aside.
