Code of Civil Procedure, 1908–Order 7, Rule 11–Fact up to the effect that the plaintiff omitted to mention about the earlier suit wherein the judgment had attained finality–He may be guilty for suppression and concealment if the averments made by the appellant are found correct–However, such a defence projected in the written statement cannot be looked into while deciding the application under Order 7, Rule 11.
