Penal Code, 1860–Secs. 420, 406, 384 & 120-B–FIR for the offence–Sustainability–Petitioner no. 1 and respondent no. 2 got acquainted with each other in the year 2019–Respondent no. 2 was categorically informed that the petitioner no. 1 is not a divorcee woman and divorce proceedings are pending for adjudication–Even after knowing this fact, respondent no. 2 continued to maintain the relationship–Expenditure made by him were voluntary–No material on record to show that he was put in any fear of injury or any threatening by the petitioner to coerce him to deliver or part with any property or valuable securities to them–Rather, it is clear that all the expenditures were made by him on different occasions out of his free will and volition–Held, impugned proceedings are liable to be quashed.
