Code of Civil Procedure, 1908–Order 7, Rule 11–Rejection of application–Appreciation of–Contention of the petitioner that the plaint is not disclosing the cause of auction–As per averments of plaint, it was the case of the plaintiff that the defendant has tried to obstruct the way by putting certain stones on it and he is bent upon to obstruct/close the way–Further, the relief was sought to the effect that if he completely obstructs/closes the way during the pendency of the suit, vide a decree, he be directed to open the same–It cannot be concluded that the reliefs as prayed for in the plaint cannot be decreed–Application was rightly rejected.
