Code of Criminal Procedure, 1973–Secs. 190 & 319 [ Corresponding Secs. 210 & 358 of BNSS, 2023 ]–Impleadment of the left out accused–On one hand, proceedings u/s. 190 of Cr.P.C. were set into motion by the order of the High Court and, on the other hand, an independent exercise of powers u/s. 319 of Cr.P.C. came into existence–The material development ought to have been brought to the notice of the Co-ordinate Court by the learned counsel for the complainant–Accused were equally duty bound to approach the Court with clean hands and disclose the said fact while filing the criminal miscellaneous petition–Certain directions issued.
