Code of Civil Procedure, 1908–Sec. 100–Scope–When the Court is called upon to interpret the document and examine it’s effect, it involves question of law–In the instant case, second appeal was filed against the decree of partition–High Court dismissed it in limine with observation that appeal does not involve any substantial question of law–Issue involved was as regard to ownership based on interpretation of documents–It constitutes the substantial question of law–Impugned order set aside and matter remanded back for deciding afresh.
