Specific Relief Act, 1963–Sec. 12–Whether the agreements to sale dated 13.08.1990 were validly executed and proved ?–One of the purchaser KS, who is a plaintiff in one suit and power of attorney holder in other suits, appeared as PW 1 and proved the execution of the agreement to sell, the payment of the full consideration to S, and also that S and the witnesses duly signed the agreement–One of the witnesses of the agreement was examined as PW 2–M who was having a registered power of attorney from S, also appeared as PW 3 and supported the case of plaintiffs–Plaintiffs discharged their burden of proving the transaction–Defendants did not choose to produce the star witness KA, son of S, as the defence witness–Plaintiff-appellants validly proved the agreement and defendants failed to establish their claim that it was a forged document.
