Penal Code, 1860–Secs. 420 & 406 [Corresponding Secs. 318(4) & 316(2) of BNS, 2023]–FIR and criminal proceedings–Sustainability–Perusal of FIR shows that the petitioner and complainant had enjoyed a mutually beneficial business relationship for a significant period of time–Several business transactions took place between the parties–Allegation in the FIR that the petitioner is not willing to pay the remaining amount–None of the ingredients of any of the offences complained against the petitioner are made out–The dispute involved in this matter appears to be of civil nature–FIR and consequential proceedings are liable to be quashed.
