Motor Accident Claims–Involvement of vehicle–Establishment–Conclusion of Investigation Officer that the vehicle was involved in the accident, was based on the information given by M–Had M knew the registraation numbers of vehicle, he would definitely have informed the same to the family members of deceased–Statements of M have not been recorded by the Investigation Officer –Further, his appearance in the evidence creates doubt on his conduct–He stated that A was also the eye-witness but statements of A neither have been recorded nor he has been produced in evidence–Vehicle was not surrendred by the owner and it was recovered from the police station itself after 21 days–No reply whatsover was preferred on behalf of driver and owner of vehicle–It is clear that the vehicle was falsely implicated–Held, findings of Tribunal regarding the involvement of vehicle cannot be sustained.
