Code of Criminal Procedure, 1973–Sec. 319–Powers under–Nature of–Powers are dis-cretionary and extraordinary–These should not be exercised in a casual and cavalier manner but only when there is strong and cogent evidence, and an accused may be so summoned if there is more than a prima facie case as is required at the stage of framing of charge but less than the satisfaction required at the time of conclusion of trial convicting the accused.
