Evidence Act, 1872–Sec. 138–Defendant no. 3 only sought the permission to cross-examine the defendant no. 1, but the trial Court travelled beyond the prayer and permitted to defendant no. 1 to file the amended affidavit–Impugned order quashed and set aside and matter remanded back for deciding the application afresh.
