Land in Indira Gandhi Canal Colony Area) Rules, 1975–Rule 14(3)–Cancellation of allotment with the view that the powers of review were not available to the allotment authority while allotting the land–Justification–Earlier, the application for allotment was rejected ex parte without giving the opportunity of hearing to petitioner–Thereafter, he filed the application u/s. 151 and the allotment was made–As per Sec. 86(2) of the Rajasthan Land Revenue Act, the Assistant Commissioner has the powers to review its own order and the order was rightly reviewed as it was passed without giving the opportunity of hearing–Petitioner is the bonafide agriculturist and he is in continuous possession of land–Impugned order passed by the Commissioner and BOR are liable to be set aside.
