Specific Relief Act, 1963–Sec. 12–Dismissal of the suit for specific performance of the sale agreement–Justification–Admitted fact that L who executed the sale agreement in favour of the plaintiff, was the partner of firm at the time of execution of same–As per partnership Act, every partner is an agent of the firm and the firm is bound by the partner’s act–Advance amount received by him was credited in the account of firm–He did not file the written statement and appeared as a witness and falsely stated that his signatures on the agreement were obtained when he was intoxicated–He executed the agreements of sale in favour of other persons in similar capacity and decree passed in their favour attained finality–Suit deserves to be decreed.
