with application revealing that the build up area was mentioned 1551.39 sq. meters–It was prepared by PW 7 who admitted this fact before trial Court–Neither the recognization of institution was withdrawn nor any complaint or FIR was lodged by NCTE–Preliminary inquiry was conducted on the basis of source information, however, name of informant was not disclosed in FIR–Further, no action was taken against the visiting team–Visiting team found
that the constructed area is as per site plan submitted by institution–Certain portions were not measured by CBI and the petitioner was forced to sign the measurement–Impugned judgment of conviction is liable to be quashed and
set aside.
