Stamp Act, 1899–Secs. 33 & 35–Registration Act, 1908–Sec. 17–Application for not exhibiting the agreements of sell, being unregistered and insufficiently stamped–Dismissal of–Justification–Suit for declaration and cancellation of the registered sale deed–Trial Court did not examine as to whether the agreements were compulsorily required to be registered or not and/or these were properly stamped or not–Material illegality is found in the impugned order–Quashed and set aside and directed to decide the application afresh.
