Code of Criminal Procedure, 1973–Sec. 145–Dispute in regard to partition of agricultural land–During the pendency of the civil suit, application u/s. 145 was filed–SDM appointed the receiver on the disputed land–He published the auction notice of crop–Plea of petitioners that the crop was belonging to them–Once a receiver is appointed, the land neither belongs to the petitioners
nor to the respondents–Receiver has no option except the auction of the crop in view of the perishable commodity involved–Held, he cannot be stopped from auctioning the crop–However, revisional Court is directed to decide the
revision as expeditiously as possible.
