Penal Code, 1860–Secs. 302 & 302/120-B–Conviction–Appreciation of–Dead body was recovered from the house of appellant L–Deceased sustained two gunshots–Two live cartridges were found missing from 50 live cartridges recovered from the accused L–Recovered gun was found non-serviceable, but it was established that it was recently damaged–Deceased was last seen with the appellants S & L–Appellant L failed to produce the passport to establish that he was out of India–Prosecution witness established his presence in the village–Explanation given by the appellant u/s. 313 points towards his involvement–Held, conviction was justified.
