Penal Code, 1860–Secs. 302/34 & 498-A–Conviction–Sustainable against whom ?–Conviction based on dying declaration–It was made to judicial Magistrate and found corroborated with medical evidence and testimony of other witnesses–Deceased specifi-cally stated that Z ignited the match stick and put her on fire–Only allegation against S that the asked the deceased to keep the door opened–It is not sufficient to infer common intention on part of S–Held, she is entitled to be acquitted from the offence u/s. 302/34–However, the conviction of all appellants u/s. 498-A is affirmed.
