Code of Criminal Procedure, 1973–Sec. 438 [Corresponding Sec. 482 of BNSS, 2023]–Imposition of condition while granting the bail that the petitioner shall not leave India without prior permission of the Court–Merely on account of the pendency of a criminal case, a person cannot be indefinitely restrained from travelling abroad, especially when such travel is essential for earning his livelihood–Merely being accused of a crime is not enough to deny the right to travel unless specific grounds justify it, like flight risk, tempering with evidence, etc. are available–No such grounds are present in the case in hand–Petitioner was granted anticipatory bail long back–There is no report of misuse of the indulgence granted by this Court–Petitioner is permitted to travel to foreign countries for a period of two years.
