Deeds & Documents–Whether the document is Will or a Gift Deed?–Though the document uses the word “Bakshish” in starting and two more places, however, it indicates that the executant was in advanced age and that after his death the entire property would vest in “S”–Use of word “Bakshishnama” alone cannot be a determining factor pertaining to the nature of document–Intention can certainly be spelled out that the executant wanted that his property is dealt with in a particular manner after his death–Document is Will and determination made by trial Court with regard to nature of the document and its admissibility cannot be faulted.
