Limitation Act, 1963–Sec. 5–Prayer of petitioner that the application u/s. 5 was considered in a composite manner while deciding the appeal–Acceptability–Once the application for condonation was presented and duly considered on merits alongwith the appeal the mere circumstance that lip service to the ritual of following procedure applicable to the civil Court was not adhered to, cannot be the basis of holding the entire decision on merits to be undone.
