Penal Code, 1860–Secs. 307 and 323/324–Application of proper Section in the cases of causing hurt–Merely because the element of hurt is common to offences under the Secs. 307, 323 & 324, it cannot lead to confusion between these provisions–Section 307 emphatically uses the words “under such circumstances” which referes the setting of crime, scene of crime, the time when the offence was committed, type of weapon used by assailants, number of assailants and nature of injuries sustained by victim–Intention and
knowledge are to be gathered from these circumstances.
