Practice & Procedure–Relief of declaration of Mahant–Though the plaintiff did not seek such relief, yet pleaded that he was duly appointed Mahant–Respondent denied this fact–Trial Court framed the issue in this regard–The Court could have granted such relief after consideration of evidence on record.
